EXECUTIVE ORDER 2020-1-2
Pursuant to the Public Health State of Emergency and Resolution No. 2020-1-2, and for the reasons stated therein, it is hereby ORDERED as follows:
Unless modified, effective at 3:00 p.m. on Wednesday, March 23, 2020, and until 11:59 P.M. on April 7, 2020, unless amended or extended, the following requirements shall be in effect:
a. Restaurants and other eating and dining establishments where food is served must cease offering dine-in services but may continue preparing and offering food to customers via delivery, drive-through or take-out services. Patrons, employees and contractors of the establishments must maintain at least six (6) feet of personal distance between themselves as much as possible given the physical constraints of the premises. If a restaurant is licensed to sell beer and wine for on-premises consumption, such restaurant, during the effective dates of this Declaration only, shall be authorized to sell unopened bottles of beer or wine along with food orders for take-out consumption off-premises. This Order is to suspend city enforcement of city ordinances and state law prohibiting certain alcoholic beverages being sold with take-out food purchases. The City has no control over state enforcement of state law.
b. All public and private gatherings of more than ten (10) people occurring outside a household or living unit are prohibited. This order shall include, but not be limited to, gyms, fitness centers, funeral homes, nail salons, hair salons, barber shops and convenience stores. Nothing in this order, however, prohibits the gathering of individuals for the purposes of carrying on business activity or the provision of medical or health services. Additionally, nothing in this order prohibits the gathering of individuals at grocery stores for the purposes of purchasing food and personal items providing all health safety protocols are practiced.
c. Based on advice from Emory University and the Center for Communicable Disease, governments must take a strong stance by Tuesday, March 24, 2020, or we will be at a point of no return. Therefore the City of Jackson has enacted a curfew effective at 9:00 P.M. on Wednesday, March 25, 2020, and extending until 11:59 P.M. on April 7, 2020, unless amended or extended. The curfew begins at 9:00 P.M. and ends at 5:00 A.M. each day. The curfew does not apply to medical services or essential businesses which have been notified of their exemption by the Office of Mayor.
d. City Hall and all City facilities shall be closed to the general public.
e. Municipal Court sessions, public meetings and public events shall be postponed until further notice.
f. Any city ordinance otherwise prohibiting this executive order is temporarily suspended during this Declaration of Emergency.
